While the law does allow cities to adopt a local alternative plan, SB 79 does not allow for an outright exemption. Local TOD alternative plans may not reduce the overall density created by the law nor reassign the increase in density to an area not within a TOD. Therefore, any “transfer” of SB 79 density is limited to only the TOD areas along the OC Streetcar route, and the additional densities cannot be transferred in other areas high-density such as South Coast Metro, MainPlace, Metro East, etc.
